User Terms & Conditions

Creative Galeria (“Creative Galeria”, “we”, “us”, “our”) is a creative studio operating from Dhaka, Bangladesh. References to “you” or “the Client” mean any individual or entity that visits our website or engages our services.

These Terms cover general use of our website, submission of enquiries, and preliminary discussions. Any paid engagement is additionally governed by a separate written Proposal, Statement of Work, or Service Agreement signed by both parties. Where a signed agreement conflicts with these Terms, the signed agreement prevails for that engagement.

• You must be at least 18 years old (or the age of majority in your jurisdiction) to engage our paid services.
• You agree not to use the site for unlawful purposes, to infringe the rights of others, or to interfere with the operation of the site.
• You will not attempt to gain unauthorized access to any part of the site, our systems, or accounts of other users.
• You will not upload malicious code, scrape the site at scale, or misrepresent your identity when contacting us.

Information shared on discovery calls, in briefs, or via our contact form is used solely to prepare a proposal for you. Proposals are valid for 30 days from the date of issue unless stated otherwise. A proposal becomes binding only once countersigned and the applicable deposit is received.

• Fees, milestones and payment schedules are set out in each Proposal / Service Agreement.
• Unless stated otherwise, projects run on 50% advance and 50% on delivery; retainers are billed monthly in advance.
• Prices are exclusive of VAT, withholding tax, and any other applicable taxes, which are payable by the Client.
• Overdue invoices may accrue late-payment interest at 1.5% per month or the maximum permitted by law, whichever is lower.
• Third-party costs (stock media, fonts, ad spend, hosting, plugins, translations) are billed at cost and pre-approved in writing.

Each Proposal specifies the deliverables and the number of revision rounds included. Feedback should be consolidated and sent within 5 working days of a review milestone. Revisions requested after final written approval, or beyond the agreed scope, are treated as change requests and quoted separately.

• Providing a clear brief, accurate information, and timely feedback.
• Obtaining all necessary rights and permissions for materials (logos, photos, copy, data) supplied to us.
• Ensuring one primary point of contact who is authorized to approve work on the Client’s behalf.
• Complying with applicable advertising, marketing, data-protection and industry regulations for the Client’s market.

• All content on this website — including text, graphics, logos, layouts, illustrations and code — is owned by Creative Galeria or its licensors and is protected by applicable copyright and trademark laws.
• On full and final payment, the Client receives the ownership rights to the final approved deliverables as expressly set out in the relevant Service Agreement.
• Working files, preliminary concepts, source code frameworks, project management systems, and non-selected concepts remain the property of Creative Galeria.
• Unless the Client opts out in writing, Creative Galeria may display the completed work in its portfolio, case studies, and marketing channels.

Some deliverables rely on third-party platforms (e.g. Meta, Google, hosting providers, plugins, fonts, payment gateways). Continued availability, pricing, and terms of those platforms are outside our control. The Client is responsible for maintaining active accounts, subscriptions, and licences after handover.

Both parties agree to keep non-public information shared during an engagement confidential and to use it only for the purpose of delivering the services. This obligation survives termination of the engagement.

We deliver services with reasonable skill and care. However, the website and its content are provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability. We do not guarantee specific business outcomes (such as sales, rankings or reach) since these depend on many factors outside our control.

To the maximum extent permitted by applicable law, Creative Galeria’s total aggregate liability arising out of or in connection with any engagement is limited to the fees paid by the Client for the specific engagement giving rise to the claim in the three (3) months preceding the event. We are not liable for indirect, incidental, consequential, or loss-of-profit damages.

• Either party may terminate a project for material breach with 15 days’ written notice to remedy.
• Monthly retainers may be cancelled after the initial 3-month commitment with 30 days’ written notice.
• On termination, the Client pays for all work performed up to the effective date and any non-refundable third-party costs already committed.

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date at the top of this page. Continued use of the site or our services after an update constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the People’s Republic of Bangladesh. The parties will first attempt to resolve any dispute in good faith. Failing that, the courts of Dhaka shall have exclusive jurisdiction, without prejudice to any mandatory rights available to consumers under their local law.
